Contribution Use Agreement
Castlemaine Zen is dedicated to supporting and showcasing the work of our Sangha. We undertake publication of Wandering Grasses, not to capture monetary profits, but for the purpose of nurturing our collective practice and sharing each creator’s unique contribution. With wholehearted respect for your creative ownership, these terms are designed to preserve as many of your intellectual property rights as possible, while granting Castlemaine Zen the essential permissions and protections needed to produce and distribute the publication effectively. Our shared goal is to nurture the sangha community and honour each creator’s unique contributions.
Definitions
The Publisher: Castlemaine Zen Incorporated (the "Publisher")
The Contributor: The individual who digitally agrees to these terms and submits the artistic or literary works (the “Contribution”) via the online form (the "Contributor").
The Journal: A serial print publication titled “Wandering Grasses: Castlemaine Zen Record”
1. Grant of Rights (Non-Exclusive Licence)
1.1. You keep the copyright. You retain the full copyright in the Contribution.
1.2. What you grant us (Non-Exclusive): You grant the Publisher a non-exclusive, perpetual, royalty-free licence to use the Contribution including permission to reproduce and publish for the first time, the Contribution you have submitted to us in the Journal.
1.3. Our Use is Limited to print and archival (digital): This licence is strictly limited to:
Print Publication: Using the Contribution in print edition/s of the Journal.
Print Limit: Print runs of an edition will not exceed ten thousand (10,000) copies. If we want to print more, we will ask you first.
Archival Digital: Using excerpts, images, or the entire Contribution in digital form solely for internal, non-commercial archival purposes within the Publisher's records.
1.4. Rights You Retain: All other rights (e.g., e-books, audio, film, translation, future formats) are retained by you.
2. Publication and Acknowledgement
2.1. Subsequent Publication Acknowledgment: If you publish or licence the Contribution to another party after its appearance in the Journal, you agree to acknowledge first publication in a format similar to:
"This work was first published in Wandering Grasses, [Edition number], [Year], published by Castlemaine Zen."
2.2. Transfer and Termination: We will not transfer or sell the rights granted to us to any other entity without your written permission. Your licence to us terminates automatically if the Publisher ceases to operate as an incorporated body.
3. Editing and Moral Rights
3.1. Minor Editing Rights: We have the right to make minor copy-editing and formatting changes to the Contribution necessary for the production of the Journal. This includes changes to the literary works (grammar, spelling, formatting) and minor technical adjustments to visual artistic works (resolution, minor colour correction, scaling to fit the page), provided the integrity of the work is not compromised.
3.2. No Material Alterations: We will not make any material alterations (ones that change the core meaning, text, or artistic integrity) to the Contribution without your express written consent.
3.3. Attribution (Moral Rights): We acknowledge your Moral Rights under the Copyright Act 1968. We agree to clearly credit you as the author/creator in the Journal. For the visual artistic works, the credit will appear as Artist Name, Title of Work, Year.
3.4 Editorial discretion: We reserve the right to decide, in our sole discretion, whether a Contribution will be used in the Journal.
4. Warranties and Indemnity (Protecting the Publisher)
4.1. Your Guarantee: You guarantee that the Contribution is your original work, contains no defamatory or unlawful statements, and that you have cleared all necessary rights for any third-party material (like quotes or external images) included.
4.2. Indemnity: You agree to cover the Publisher for any costs or claims that arise if you breach the guarantees made in 4.1.
5. General Terms
5.1. No Payment (Volunteer Contribution): You confirm that this is a volunteer contribution. No payment, royalty, or fee will be paid to you.
5.2. Free Copies: You will receive 1 free copy of the Journal in which your Contribution appears.
5.3. Governing Law: This Agreement is governed by the laws of the State of Victoria, Australia.
